A Good question and the answer is that it probably is legal. What exactly constitutes a sexual act has been considered a lot in various courts around the world. The fundamental point appears to be if there is no physical contact between
two parties normally a sexual act is deemed not to have taken place. So for example going lap dancing is generally legal unless you go into a private area and have your genitals stimulated which would constitute a sex act. Also if you are in a private area
while watching somebody perform a sexual act e.g. playing with a dildo and you then masturbate this possibly would amount to a sexual act. I am not sure if their is any jurisprudence relating to the legality of phone sex but I think it would be very difficult to convict the parties involved under the terms of any existing or proposed legislation.

Phone sex, internet sex and all sex where people are not in the same place was specifically excluded from the new legislation in the North.
