Double Jeopardy means he could not be tried twice for the same crime,this was an appeal not a new charge.

During his trial he was charged with a lesser crime , convicted , and done the time .

Now State comes back and ups the ante and is he being charged , or already done deal convicted of murder ?

Why they not charge him with Murder in the first place !!?

Checks and balances . Government (just as persons do) need to have them .

Dude was guilty as sin . They chose to charge him with a lesser crime .

Is there any New Evidence to warrant a retry or re-conviction ?

RSA obviously has a different legal system to ours, as an appeal of this nature could never happen here. The only appeal on the prosecution side here would be on leniency of the sentence.
