The garda does have to prove that the person is breaking the law.
If no information is given and the garda are only going by speculation, then there isn't much that they can do.

With the phone they took, they are not allowed to access it without the permission of the owner or get a full warrant.
If they unlock the phone and use any information from what they find, then it is possible that if taken to court, that evidence will be thrown out of the window and the accuser could press charges.
Phones hold a lot of person data of your friends and family information, then you have photos and other person information
If any of this information is viewed or even released, then there could be big problems for the garda.

As for the BigBen leaving, the garda saw him leaving a building who claimed to them that he has business to attend top, but what business is that is something the garda didn't get and were not happy with not getting any answers they wanted to hear, which also means that that cannot use it against the accuser.
If they do, then this will be looked into and by then, the accuser may have to answer this and may even give out an answer in which they are not looking for anyway and therefore they all have wasted time.


This may not be fully correct, if so note if I am wrong or missed something.

I don't get this story as its not professional behaviour and some will try it on hoping the client is too afraid of doing anything and it does come as a big shock to see them.
I never saw one snapping a phone though, yes they may ask could they see it if you nothing to hide.
With the raids they do have warrants though. I Hope that this is not the start where they really begin to enforce this law
