The guard knows he only has you on a whim. Be polite, wish the guard a good day and tell him you would like to leave. Always be polite and don't break eye contact. After identifying yourself you are allowed to stay silent. Worst case scenario he takes you to the station where you remain silent, a solicitor will come and you're out in no time charge free.

    If you have a record you're actually in a better position than the man without one. You tell him you're name and then tell him I'm ringing my solicitor, you're picking on me cos of who I am, you're not stopping anybody else or at least I didn't see you. We'll see what my solicitor has to say about you stopping me on the street and I'm going to the Ombudsman about for you stopping me for nothing. He won't want the grief of it all incase it can be construed as picking on you.

    See the guards uphold the law. But the laws are written up in your favor and not the guards. Don't be letting the thoughts of the wife or family into your head because that shows on your face and to the guard it just looks like guilt over what he has stopped you for.

    Identify yourself politely and stay calm.

    Are you sure about this.
    You only need give your name and address if suspected of commiting a crime.

    Correct Tony you are only obliged to give your name and address to a Garda if he or she says they suspect you are after committing an offence . If they do and you give your details I suggest you refuse to answer any questions without your solicitor present and then it’s up to them to arrest you and bring you in for questioning..Gives you more time to come up with a story as to why you were visiting an apartment or whatever ..

    As previous posters have said all you have to give is your name and address. You can ask them why they want it before you give it to them. You dont have to give it to them but i would. Everything else they ask just say no comment. They will eventually get pissed off and send you on your way.

    In what circumstance would Guards already know your identity if they are watching an establishment ?

    I suppose you could do that. Depends if they will radio to control to check your details.

    From your car registration. I know that it is recommended to park a bit away and walk but if you are directed to the location where the escort is staying they have your registration number.

    What if the car is under garage insurance, what if it's an open policy where anyone with a full license over a certain age can drive the car, what if he has a lend of the car because his policy allows him to drive other peoples cars, what if the car is not in his name.
