Thread: Advice if stopped by guards

    I would be interested in this thing: if Garda stop u as a client asking like the lady asked this guy:'' may i talk with u? ' u have the right to refuse to talk and just answer plain , no i dont want to talk? on what basis they can detain you? or can they? If they cant detain you then u free to go, right?

    If are you stopped by the Guards like this guy was, if in public place and asked for your name and address, give it to them, you could be detained or arrested otherwise and why would you not give it to them.
    Then just be nice and act normal.
    Remember they are the law and this guy was getting into his vehicle too, being a smart alec here and they could ask for drivers license MOT Test cert, check tyres, brake lights and look over your entire car so don't bring them on you like this
    I have been stopped a few times and found if you're civil and cooperative then they are okay and you'll be on your way in no time.

    The only way Garda can prevent you leaving a location after you have indicated your wish to leave (legally) is to arrest you. If they try to keep you in a location after you have told them you wish to leave, they themselves could be committing an offence.

    No, if you are uncooperative the Guards can legally detain you, it is different to arresting you so be aware of this too

    Their is no such thing in the civilized western world as "legally detained" outside being arrested. Although I suspect some Garda would try to bullshit you otherwise. "Legally detained" is arrested.

    its not they are different, you can be detained without being arrested.
    Why are people worrying so much about this anyway, All you have to give is you name address and that's it.
