    Laura Lee is challenging it in court. Also sting operations against clients will be harder to implement here, also because the resources required. People in rural areas are very unhappy about Gardaν stations being closed all over the country and the head of the Swedish anti-trafficking unit said it will be resource intensive in her interview with the Irish Times - money the Gardaν don't have.

    PURCHASE OF SEXUAL SERVICES
    Payment etc. for sexual activity with prostitute

    20. The Act of 1993 is amended by the insertion of the following section after section 7:
    “7A. (1) A person who pays, gives, offers or promises to pay or give a person (including a prostitute) money or any other form of remuneration or consideration for the purpose of engaging in sexual activity with a prostitute shall be guilty of an offence and shall be liable on summary conviction—
    (a) in the case of a first offence, to a class E fine, and
    (b) in the case of a second or subsequent offence, to a class D fine.

    (2) In this section “sexual activity” means any activity where a reasonable person would consider that—
    (a) whatever its circumstances or the purpose of any person in relation to it, the activity is because of its nature sexual, or
    (b) because of its nature the activity may be sexual and because of its circumstances or the purposes of any person in relation to it (or both) the activity is sexual.”.


    Amendment of section 5 of Act of 2008
    21. Section 5 of the Act of 2008 is amended by—
    (a) the insertion of the following subsection:
    “(2A) A person who pays, gives, offers or promises to pay or give a person (including the trafficked person) money or any other form of remuneration or consideration for the purposes of the prostitution of a trafficked person shall be guilty of an offence.”,
    and
    (b) in subsection (5), by the substitution of “sections 7 and 7A of the Act of 1993 in so far as an offence under those sections” for “section 7 of the Act of 1993 in so far as an offence under that section”.

    Wonder does 'webcam' sex constitute a criminal offence?

    Does sex phone lines constitute a criminal offence?

    Both cases meet the criteria.

    Nice to see the legislation refer to 'prostitute' rather than mere 'person' :-( . Just so that we all stigmatise them from other persons . From our 'Justice' Minister...

    I don't know about the Southern Law, but the Northern Law specifically mentioned that the person doing the purchasing at some time had to appear in person.

    I don't see how you can define "sex" as something that happens between two people who are in two different places.

    Says clearly paying any person

    However method of payment for sex is not clarifyed

    So in fact one could argue buying a girl drink and getting her Hanmered as a method of payment
    Also a new directive by our justice minister is did you give consent...Consent is only valid if person is of sound mind so don't get her too hammered

    Drinking with a hooker will be like rape I guess then

    States any other form of remuneration or consideration while that could include drink more likely it refers to gifts e.g. expensive perfume or sex toys. This consent thing is taken to extremes at this stage very soon we will be back to a situation not uncommon in this country in the past that all sex should be solely for the purposes of procreation.

    This was the very point made by an English commentator about the the adsurdity of the Northern Law. Technically, buy someone a drink or a meal and then have sex with them is now an offence.
