I am not an expert but I believe the legal crux of the matter will be proving that payment has taken place. It will not be sufficient to arrest someone leaving the apartment of a known sex worker, I could be the cleaner for gods sake. The solution in my opinion is to find clever ways of paying for the service that cannot be related to payment for sex. There will be a legal requirement to prove a case and if the Gardai have to use scarce resources chasing bank accounts and transactions or whatever then convictions will be slow, or non existent. If we all get freaked out every time a Garda car passes as we are walking along the street then the law will be even more successful than ever. Know your rights if stopped, know what you are legally required to answer and answer nothing else, this is a good rule to adopt at all times anyway as it really pisses them off if they think you know what to say not to say.

The elephant in the room is the media, I suspect the Gardai will use puppet news outlets to publish photos of "suspects" the thought of a public outing will be worse than any fine.

If and when the law comes into force the first few cases will be headlines, after that, and if there is someone brave enough a constitutional challenge could see it defeated as it is impossible to criminalise one half of a transaction. Only my thoughts.

Just going through the forum here and there's so much concern about the possibility of ROI following suit with the new legislation in the North. Maybe I'm missing something but I can only see this being enforced with street prostitution - how on earth can it be proved that a guy in a hotel room has paid a girl? Unless a policeman is actually there and sees money being handed over how can they disprove 'oh she's my fb {fuck buddy - technically true} or we are having an affair etc? Unless someone has tipped police off about a working girl why would they even bother trying to find guys going into hotels? I just dont see what the panic is. Just remember that in order to justify this law, the police would probably be primarily focusing on collaring people who pay for sex. If they concentrate their efforts in finding 'crime', they will either find it, or build a case to look like it. Brace yourself for more ambiguous reports on the success of this law

I'm not an expert either but I think if gardai know a sex worker is working in a particular place and observes someone entering that location and staying a period of time without persuavive evidence of them being there for a legitimate reason, that is enough evidence to arrest someone on suspicion. Gardai don't need to have 100% incontrovertible evidence to make an arrest.


Proving what actually happened inside an appartment may be the difficult part........ assuming time and companionship is not made illegal too.

The problem for a lot of punters will be the threat of publicity, through a court case or even the media, to avoid this a lot will, if given the option, pay a fine instead.

If you get caught once and end up paying a fine for €500 .... € 1000 who knows how much, how likely are you to take the risk of being caught a second time.
