I never really thought about it to be honest — perhaps I should!

The thing is, it has to be very hard for a Guard to prove what what he thinks has gone on in a private apartment. Even if there were 2 ladies in the apartment how can they prove you actually paid to have sex with one of them?

Agree don't be a smart arse and you will be fine. Was caught years ago dropping a lady off and the guards were pretty up front and okay.

They can only demand your name and address if they have evidence you have committed a crime. So you are quite entitled to stay quiet.

Many years ago, in one of those exercises, when the gardai decided to tackle prostitution, I was stopped, gave name and address, and let go.

A few days later I was phoned at my place of work, and told that I was required to as a witness, to give evidence in court, against a girl charged with prostitution.
I refused to go as a witness and was abused verbally by said garda.
I made a complaint to the relevant garda station, and was told that it was just an over eager garda.
He continued to hassle me,( f**k language etc) and I refused to go to court as a witness, unless a witness summonse was served on me.
The case was in the papers and dragged on with adjounments.
The girl was given the probation act

The names and adresses of at least half a dozen witnesses were published,,,,I am sure that they were never served with witness summonses, and felt so sorry for them.

Disregard advice from zoozoozoo. If you act like a prick to them you will get it back 10 fold. Provide minimum required in a polite way. Asking them for names numbers and other bullshit like that will get you nowhere. As for bollox story above. It is bollox. If guard wanted you in case it's cause you provided evidence in which case he would have witness summons you.
Be smart, courteous and provide name and good story about hooking up after a night out last week.

and that was just leaving the apartment, you were not even caught with the girl in the room which would be much worse

In my experience and from what I have heard , whether there is 1 girl or 10 in an apartment, generally the client is left alone. Of course you will always get the odd twat Garda, but you as a client have done nothing illegal.

The real problem here is that you are all presuming the gards will not make stuff up.

They do. They can say that you said / admitted / claimed anything. And every other gard present will back them up.

I would definitely not go down the road of being smart, cheeky or a pain-in-the-arse.

Almost nobody knows their rights and gardai are accustomed to having their questions answered. If you refuse to answer you will stick out like a sore thumb. However, I would resisit saying anything in these circumstances, the above notwithstanding.

A gard can (as far as I know) ask for your name and to explain why you are where you are, though this might not be the case nowadays.

I would give my name and address and say little else. I would politely explain that I have to go as I have an appointment. They must either arrest you or let you go - they cannot hold you otherwise.

Be polite and pleasant. Say that you need to go. IF they try to prevent you from leaving ask if you are under arrest.

If they say no, just leave.

If they say yes, call a solicitor but say nothing more to them.

Gards are tricky people and can play the game way better than you will ever be able to play it.

As another poster said, they could even arrest you on suspicion of pimping if you piss them off sufficiently.

Tread carefully but try to get out of there asap.
