Thread: A serious question - Garda

Default A serious question - Garda

    Hi all,

I seldom post but I am a long term member. I was wondering what my position is on the below.

I was contacted by Garda on my phone and he asked me to meet him at a station. It was in connection to an escort I had previously visited. Her phone had been seized by the Gardai and my text was on it. This was revealed at the station.
It was a cordial conversation however as it progressed I agreed to give my details and a short written description of the meeting with escort. It was explained to me that this would be used to build a case against the individual running the operation.
I was not under arrest and I was advised the documented was not a statement. I did it to actually assist the Gardai. However, in hindsight I have regretted this decision. There is document with my signature admitting availing of the services of an escort. I'm actually quite worried about this and would like to withdraw the document.
Just wondering if anybody else has been in this predicament? thanks

There might be something useful for you in this thread.

However there are people here that are familiar with the law and may advise you, the fact they said it wasn't a statement maybe it won't go any further for you.

Thanks for the replies. I should clarify that I was not placed under arrest nor did I give a statement. This was confirmed by the Detective. I was informed that if I provided information of the event it would only be a given to judge to make a case against the alleged pimp. I don't have a problem with that. What I do have a problem with is how the document will be treated in the future. Will it go into a permanent evidence file? I'm more concerned about my privacy being infringed or possibly a record existing of this if I have dealings with the Gardai (on any grounds) in the future.

It will be put into the pulse system tjats there forever at the click of a button im afraid.if the guard gave you his word well then you might not be too bad.how along ago were you in touch with the guards..did he read over what he wrote to you.i was in a situation once where i volunteered to the station like yourself gave my version of events and asked questions.

Wasnt under arrest but got charged a week later it wasnt escort related but was serious enough offence.it sounds like you gave whats know as a brief statement.you maybe called back in to give a full version of events.i wouldnt worry about it you wont go to jail

I was advised it wasn't a statement of any kind but will be used to build a case against the pimp. I have no problem helping the Gardai where a pimp is involved. The detective advised that the document would only be shown to the judge. He said no other Gardai could access the information and I will not be called to court. He also said it would not appear on any record. I asked plenty of questions before I committed.
My real concern is what might happen to the document in the future, even after the case has been concluded.

I suggest the op has little or nothing to worry as the gardai would not be interested in the punter more in making a case agains the escort/pimp.

But let this be a warning to all. Escort phones are frequent confiscated if a place of work is raided for what every reason. Allow me to suggest the following.

    1. Always use a punting phone/sim
    2. Never allow an escort to save your username in her phone.
    3. Never text anything like arrangements or requests that may indicate a transaction is taking place.

How a punter could not allow me not to save his phone number with his username?
Will he ask for my phone to save his number as he wishes?
    Or how?

I think the guys who use punting phones are the ones who need to hide it from wives/girlfriends.guards cant do anything if your number is simply a received call on tge escorts phone.anyways dont panic man

I really don't think you have anything to worry about as you weren't under arrest and it wasn't a statement.
I don't know the legality, but the Gardaí are obliged under the Data Protection Act just like any other organisation.
I also believe you can have access to that information and the purpose that its being used for.
