The judge argues that preventing their free speech would be unconstitutional. I've often heard the reverse that argument before - for example, lefties will often demonstrate against right-wingers using the slogan "No Free Speech For Fascists".

Church members, led by the Reverend Fred Phelps, have picketed outside numerous military funerals to draw attention to their view that US military deaths in Iraq and Afghanistan are punishment for the immorality of Americans, including tolerance of homosexuality and abortion.

For about 30 minutes before the funeral began, the protesters marched with signs reading: "Thank God for Dead Soldiers", "You're Going to Hell" and "God Hates the USA/Thank God for 9/11".

That said I fully agree with the courts finding- I live here in the US & it took me a few years to wrap my head around the free speech thing but if you follow the logic it makes much sense... it leads to some rather bizarre situations, eg, escorting is illegal in US ( outside of a few Nevada counties & city of Providence, RI) but there are plenty of very active Punting sites & Vice will never touch them for fear of running afoul of the first amendment ( if you ever read of such outfits being busted e.g. Escorts.com earlier this year, it's to do with suspected trafficking etc).
Look on the bright side, the very existence of Phelps & his cronies serves some good: Even most conservative Americans recognize evil when it's standing on front of them!
