Default A question on the Law?

Ok, so the Gardai need a Warrant:

They cannot enter your home or place of work without your consent. A search warrant is needed in most circumstances except where they an arrest warrant for someone occupying the premises or if in pursuit of a suspect.

Ok, I understand that but seeing as:-

It is an offence in Ireland for escorts to advertise the escort services they provide.

If the Gards do question you, at the door or in your room, should you answer a minimum of questions because surely if they know you advertise online, the whole thing is blown out of the window?

Can you refuse to answer questions?
If they turn up with NO warrant, can you refuse to answer the door? can you NOT let them in and ask politely that they leave and perhaps call their station seargent to register a complaint....after all You are working within the law. If you do this will it cause reprocussions ie:they may return with a warrant?

The law is there but like the UK police, they certainly pulled the wool over my eyes.

    Hindsight is a wonderful thing.

a lone female is committing no offence nor is her client. it is not an offence to pay a lady for sexual favours. a man could bribe his wife/girlfriend for example. not sure about the advertising but gardai dont seem to bother about it. a warrant is definitley needed and they must have reasonable grounds that a premises is a brothel they must satisfy a judge on oath that this is the case .
the trouble is in reality if clients get a sniff of police activity particularly in rural towns they will avoid
you experienced a little bit of police harrassment

Far as i know, theres nothing for one to fear unless your working in 2's or 3's or working for a pimp

Aside from this, the gardai don't care much unless other disturbances are involved like excessive noise etc..

Besides if two girls are working together then that shouldnt be a prob. If they organise themselves one can just pose as a friend living with her mate who happens to do some escort work. Bham, its not a brothel then!

always wondered about this, suppose if shes in a hotel room or rented apartment then not legally her property and if guards asked hotel/flat owner that might give them a legal figleaf to enter room without warrant or permission from person in the room ?

In Ireland, the guards do whatever they want to regular people - the law is only some things written down somewhere. You just have to keep your fingers crossed that their paths don't cross with yours.

In my own experience be polite, keep you answers short and to the point and keep quiet after that. Don't invite them in and you can leave them at the door so you can check their credentials by pining the station.
