It does make a bit of a (bigger) arse of the law when they keep changing their mind.
Even when that “change of mind" is described as “an appeal”.

The whole point of these appeals is to give justice a second chance, this appears to be a great example of a reason for the appeal system,

    Justice delayed is justice denied.

I wasn't there so I don't know what happened, but what I do know is dragging someone repeatedly through the courts isn't right either.

    What about Double Jeopardy ?

    Should that not apply ?

: once acquitted of a crime , you cannot be charged again for same said crime -- especially if already spent the Time ... ?

In this case I do believe the initial judgment was way too light , but the principle of the law should stand , no ?

( I'm going on US law , it might be diff in SA , though they are also based on the Old English common law , no ?) x
I do what I want. I cannot do otherwise.

Double Jeopardy means he could not be tried twice for the same crime, this was an appeal not a new charge.

'Appeal' usually works in trying to exonerate a person , or if there were some legal irregularities during Trial :

that could be either incompetent Defense , tampering with witnesses or evidence , etc .

Also , if New Evidence has been found or came to light since / after judgment ,

a new trial may be requested , and may be granted . It is rarely done though .

I am not familiar with SA law , but my understanding is that it is based on the Olde English Common Law ,

just as US Law is based on .

So I'm a bit confused how they can go ahead and 're-charge' a person for the same criminal action that he had already

    'done the time for' .

: My confusion is only re the legality of the issue .

Morally -- I think he shoulda been sent up the river forever on the first go-round x
