Needs to be tested in the courts asap. At worse this will allow a certain amount of clarity about what you might be able to get away with at best this Islamic/Calvinistic/Feminist piece of legislation will be stuck out. In some cases it will be almost impossible for the cops to get a charge to stick but beware this law offers considerable scope for raids on brothels (i.e places with more than one girl working)and almost inevitably sting operations which the law is clearly designed to facilitate. Interesting as well will be how it is to be administered i.e will the discrete option of an on the spot fine be available or will as I fear may transpire a string of public humiliations of punters be the order of the day. All in all a bad day for the Republic and a good day for the parasitic NGO's who have championed this cause encouraged by Blue Shirt Fitzgerald.Originally Posted by Catriona
Laura Lee is challenging it in court. Also sting operations against clients will be harder to implement here, also because the resources required. People in rural areas are very unhappy about Gardaν stations being closed all over the country and the head of the Swedish anti-trafficking unit said it will be resource intensive in her interview with the Irish Times - money the Gardaν don't have.

PURCHASE OF SEXUAL SERVICES
Payment etc. for sexual activity with prostitute
20. The Act of 1993 is amended by the insertion of the following section after section 7:
7A. (1) A person who pays, gives, offers or promises to pay or give a person (including a prostitute) money or any other form of remuneration or consideration for the purpose of engaging in sexual activity with a prostitute shall be guilty of an offence and shall be liable on summary conviction
(a) in the case of a first offence, to a class E fine, and
(b) in the case of a second or subsequent offence, to a class D fine.
(2) In this section sexual activity means any activity where a reasonable person would consider that
(a) whatever its circumstances or the purpose of any person in relation to it, the activity is because of its nature sexual, or
(b) because of its nature the activity may be sexual and because of its circumstances or the purposes of any person in relation to it (or both) the activity is sexual..
Amendment of section 5 of Act of 2008
21. Section 5 of the Act of 2008 is amended by
(a) the insertion of the following subsection:
(2A) A person who pays, gives, offers or promises to pay or give a person (including the trafficked person) money or any other form of remuneration or consideration for the purposes of the prostitution of a trafficked person shall be guilty of an offence.,
and
(b) in subsection (5), by the substitution of sections 7 and 7A of the Act of 1993 in so far as an offence under those sections for section 7 of the Act of 1993 in so far as an offence under that section.

Both cases meet the criteria.
Nice to see the legislation refer to 'prostitute' rather than mere 'person' :-( . Just so that we all stigmatise them from other persons . From our 'Justice' Minister...

I don't know about the Southern Law, but the Northern Law specifically mentioned that the person doing the purchasing at some time had to appear in person.
I don't see how you can define "sex" as something that happens between two people who are in two different places.
Best of luck to Laura. You are correct that a comprehensive enforcement of the law even if desired would be beyond the resources of the police, nevertheless, this new legislation by virtue of the fact it will be an offence to "attempt" to purchase sex offers scope to the cops to trap unsuspecting clients as they have done in the past with respect to the street trade.
