Yes that probably is true depending on how you got on would be a key element and obviously what would happen with the material once you had it in your possesion. I myself have done amatuer videos with clients in the past that I felt comfortable with and they just added them to their private collection which is ok. I would not do a phone recording though to be honest it would need to be video or photos and ofcourse a mutual agreement xxxx
